Account Security: You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Responsibility for Content: You are solely responsible for any content you submit, post, or transmit via the Platform ("User Content"). You warrant that you have all rights necessary to do so and that your User Content does not infringe on the rights of any third party.

License to Use Content: By submitting User Content to the Platform, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Platform and our business.

We may terminate or suspend your account and access to the Platform at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason.
Disclaimers: The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: To the fullest extent permitted by law, Flywater, LLC, its affiliates, and their respective directors, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (i) your use or inability to use the Platform; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; or (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Platform by any third party.
You agree to defend, indemnify, and hold harmless Flywater, LLC, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including, but not limited to, your User Content, any use of the Platform's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Platform.
These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree that any dispute arising under or in connection with these Terms or the Platform shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you hereby consent to the jurisdiction of such courts.
We may update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Platform thereafter. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
